A 17-year-old Chimacum boy said he was sorry Jan. 18 when he pleaded guilty to three counts of voyeurism and one count of displaying intimate images he took with his cell phone at a Port Hadlock business and a Port Ludlow residence.

Jefferson County Superior Court Judge Keith Harper sentenced the youth to 21 days at a Kitsap juvenile detention center in Port Orchard for disclosing intimate images by sending them to the 4Chan website.

Sentencing on the voyeurism charges was delayed until March 15, after a pre-sentencing report has been completed.

Most of the victims were fellow Chimacum High School students, as well as employees of Ferino's Pizzeria, whom the youth admitted filming without their knowledge, according to court documents. The youth was expelled from Chimacum High School in December and has been enrolled in a school in Kitsap County. He cannot attend school while at the detention center.

Deputy Prosecutor Cheryl Potebnya said the youth will have turned 18 by the time he is sentenced, but the case is to remain in juvenile court.

Potebnya declined further comment on the plea agreement until a pre-sentencing report has been completed.

Earlier, the youth had pleaded not guilty to four counts of voyeurism based on the incidents at Ferino's alone. The teen had worked at Ferino's when the remote filming took place in an employee restroom.

The counts were amended Dec. 28 with more victims added to the two counts involving incidents at Ferino's, and a third count added that involved filming two people with a concealed camera phone in a bathroom at a home in Port Ludlow, according to court documents.

The additional charge came after the youth was expelled from Chimacum High School in early December.

In a letter Potebnya submitted into evidence, Chimacum High School Principal Whitney Meissner wrote that the youth was being expelled because, in May and June 2016, he had “unlawfully video-recorded female students in classrooms and in the hallway” of Chimacum High School.

Meissner also alleged that in June, the youth video-recorded a female student at a private home in Port Ludlow. The video in that case was not posted online.

Defense attorney Scott Charlton, who is representing the youth, said the young man apologized to everyone who showed up in court.

“He did express contrition,” Charlton said. “He has a 0 offending score, basically no prior history. So the standard range would have been 0-30 days.”

Voyeurism is a Class C felony. An adult convicted of that crime could be required to spend a maximum of five years in jail, pay a $5,000 fine and register as a sex offender.

Harper is set to preside over the sentencing in juvenile court, and sentencing recommendations on the voyeurism have not yet been made.

PROBABLE CAUSE

Jefferson County Sheriff's Detective Brett Anglin wrote in a probable-cause statement that he responded to the Port Hadlock pizzeria in September after the owner reported Facebook postings and calls that someone had hidden a camera in an employee restroom.

“The video depicted the women's bare buttocks, however, the videos did not depict any other intimate areas. There were four videos in all,” Anglin wrote.

Anglin indicated that one of the employees said she believed the videos were taken between July 8, 2016 and Aug. 29, 2016, based on how she wore her hair in the videos.

Anglin obtained a search warrant for the 4Chan website, on which the videos had been posted. The detective was provided with an IP address for the person who posted the four videos. A search led Anglin to CenturyLink. Anglin then obtained a search warrant for CenturyLink in an attempt to identify the IP address, and that led to the discovery of the address of the youth's parents in Chimacum, according to court records.

The youth consented to a search of his room and computer, which was taken into evidence.
