Charge of felony assault dropped after victim moves

A Bremerton man who was facing a felony charge of second-degree domestic violence assault after he allegedly crashed into his ex’s vehicle and tried to run her off the road near Bridgehaven was released from jail after a plea deal with prosecutors.

Yordi Giovanni Silva Lomeli, 22, was arrested for second-degree assault with four other felony and gross misdemeanor charges in late August.

During a court appearance Feb. 4 in Jefferson County Superior Court, Silva Lomeli admitted his guilt in violating a no-contact order and was sentenced to 364 days in jail, with credit for 163 days already served and 201 days suspended.

The plea agreement was approved by Superior Court Judge Keith Harper and Silva Lomeli was released from Jefferson County Jail Feb. 4.

According to Chief Criminal Deputy Chris Ashcraft, the victim in the case has moved out of state and Silva Lomeli entered a guilty pleading to the one charge that prosecutors could prove without her presence.

Silva Lomeli was arrested just after 1:30 a.m. Aug. 25 after his ex-girlfriend told police he rammed the back of her car and then drove past her, angled his vehicle in front of her’s, and forced her car to a halt. He then allegedly began pounding on one of the windows.

Fearing for her safety, she called her father and Silva Lomeli drove away.

The woman’s father later found him in Kitsap County and the pair got into a scuffle.

Silva Lomeli was subsequently arrested by Bremerton police. At the time of his arrest, authorities said he had been under investigation for an alleged attempt to kidnap his ex from the east Bremerton area in mid-August and take her against her will to Mexico with their two young children, according to court documents.

During Silva Lomeli’s court appearance Feb. 4, attorney Samuel Feinson said he had no doubt his client would be able to meet the requirements of his sentencing, which included the suspended sentence that requires Silva Lomeli to have no criminal law violations for two years.

“It represents Mr. Silva Lomeli taking responsibility for the only charge that would have been proveable at trial without the complaining witness,” Feinson told the judge before Harper announced the sentence.

Feinson said Silva Lomeli has a good network of friends and family in Kitsap County.

“I know he is a hard worker,” Feinson said, adding that he doubted Silva Lomeli would be back in any courtroom once unresolved legal issues are finalized in Kitsap County.

Silva Lomeli declined to say anything before his sentencing.

Harper followed the recommendation of the plea agreement, which included a no-contact order with the victim personally or through any other people. Silva Lomeli was also ordered to stay 1,000 feet away from her home, school, or workplace.
