The Trump administration plans to end the census count on Sept. 30.

Since we have been in a partial lockdown for six months and experts estimate that roughly 40 percent of households have not submitted census data, this would almost certainly result in an undercount.

The census is mandated by Article I, Section 2 of the United State Constitution which states: “Representatives and direct Taxes shall be apportioned among the several States … according to their respective Numbers…” Section 2 of the 14th Amendment amended Article I, Section 2 to include that the “respective Number” of the “several States” will be determined by “counting the whole number of persons in each State, excluding Indians not taxed”.

Since both President Trump and Commerce Secretary Ross swore to “support and defend the Constitution,” they have a duty to complete the census as Constitutionally specified. The census count should be continued until “the whole number of persons in each state” have been determined.
